1. Service Description

1.1 What We Provide

This service provides access to a password-protected Moodle-based learning management system offering educational materials for AP Latin, including but not limited to:

• H5P interactive activities
• Lessons and instructional materials
• Practice exercises and assessments
• Study guides and resources
• Supplementary educational content

AP® is a trademark registered by the College Board, which is not affiliated with, and does not endorse, this website.

1.2 Educational Purpose

All materials are designed for educational purposes to support AP Latin learning and are aligned with AP Latin curriculum standards.

2. Content Ownership & Copyright

2.1 Our Intellectual Property

• All content, including text, graphics, H5P activities, assessments, lessons, and other materials ("Content") are protected by copyright and other intellectual property laws.
• Content is NOT created by, endorsed by, or affiliated with the College Board.
• Materials are aligned with AP Latin curriculum standards but are independently produced.
• All materials are the exclusive property of Omnia Bona, LLC or its licensors.

2.2 College Board Disclaimer

While our materials are designed to align with AP Latin learning objectives, they are independently created and not endorsed by the College Board®. AP® and Advanced Placement® are registered trademarks of the College Board, which was not involved in the production of, and does not endorse, this product.

2.3 What You MAY NOT Do

You explicitly agree that you will NOT:

• Download, copy, reproduce, or duplicate any Content from this site
• Share your login credentials with anyone else
• Distribute, sell, license, or transfer any Content to third parties
• Screenshot, record, or capture Content for redistribution
• Use Content for commercial purposes
• Remove or alter any copyright notices or attributions
• Create derivative works based on our Content
• Use automated tools (bots, scrapers, etc.) to access or download Content
• Access the service through any method other than the provided interface
• Reverse engineer, decompile, or disassemble any portion of the service

2.4 What You MAY Do

• View and interact with Content online through your personal account
• Take notes for your own personal educational use
• Print individual pages for your personal study (NOT for distribution)
• Use the materials to support your own Latin learning

3. Subscription Terms

3.1 Subscription Duration

• Subscriptions are valid for one (1) year from the date of purchase
• Access begins immediately upon payment confirmation
• Subscription automatically expires after one year unless renewed

3.2 Pricing

• Subscription fees are stated clearly at the time of purchase
• We reserve the right to change subscription prices at any time
• Price changes will NOT affect current subscribers until their renewal date
• You will be notified of any price changes at least 30 days before your renewal date

3.3 Payment

• Payment is due in full at the time of subscription purchase
• We accept Stripe payments
• All fees are in US Dollars
• Payment processing is handled securely by Stripe

3.4 No Refunds — Read Carefully

• No refunds if you change your mind
• No refunds if you don't use the service
• No refunds if you don't pass your AP exam
• No refunds if the materials don't meet your expectations
• No refunds for unused time on your subscription
• No partial refunds under any circumstances
• No exceptions

Exception: Refunds may be provided if required by law in your jurisdiction. This policy does not override mandatory consumer protection laws.

3.5 Renewal

• AP Latin section subscriptions do NOT automatically renew
• You must manually renew your subscription before expiration to maintain access
• We will send you a reminder email 14 days before your subscription expires
• Renewal is subject to the then-current subscription price and Terms

3.6 Cancellation

• You may stop using the service at any time
• Stopping use does NOT entitle you to a refund
• Your access will continue until the end of your paid subscription period
• No refunds for early cancellation

4. Account Responsibilities

4.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Using a strong, unique password

4.2 Account Sharing Prohibited

• ONE subscription = ONE user only
• Sharing your account with others is strictly prohibited
• We reserve the right to terminate accounts that are shared
• No refunds will be provided for terminated accounts

4.3 Accurate Information

You agree to provide accurate and complete information during registration, update your information if it changes, and use your real name and valid email address.

5. Acceptable Use Policy

5.1 Prohibited Activities

You may NOT:

• Violate any applicable laws or regulations
• Infringe on anyone else's intellectual property rights
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Upload viruses, malware, or harmful code
• Harass, threaten, or harm other users
• Use the service for any commercial purpose
• Impersonate any person or entity
• Collect or harvest information about other users

5.2 Educational Use Only

• This service is intended for personal, non-commercial educational use only
• Content may NOT be used in a commercial setting without written permission
• Teachers and institutions must contact us for separate licensing

6. Disclaimers & Limitations

6.1 "As Is" Service

The service and all content are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or completeness of content, or uninterrupted or error-free service.

6.2 No Guarantee of Results

We do not guarantee that you will pass the AP Latin exam, any specific score or academic outcome, that the materials will meet your specific needs, that the service will be available at all times, or that errors will be corrected.

6.3 Limitation of Liability

We are NOT liable for any indirect, incidental, consequential, or punitive damages; lost profits, data, or opportunities; failure to achieve desired academic results; service interruptions or technical difficulties; errors or omissions in content; or third-party actions or content.

6.4 Educational Materials Disclaimer

• Materials are designed to align with AP Latin standards but may not cover everything on the exam
• We are not responsible for changes to the AP exam format or content
• You should supplement these materials with official College Board resources
• Success depends on your effort, prior knowledge, and many other factors

7. Data & Privacy

7.1 Data Collection

We collect and process certain information when you use our service. Please review our separate Privacy Policy for details.

7.2 Your Content

• Any content you create or upload (notes, responses, etc.) remains your property
• We may access your usage data for service improvement purposes
• We do not sell your personal information to third parties

7.3 Data Retention

• Your account data will be retained for the duration of your subscription
• After subscription expiration, we may retain certain data as required by law
• You may request account deletion (see Section 12)

8. Termination

8.1 Termination by You

You may stop using the service at any time; no refund will be provided. To request account deletion, contact us (see Section 12).

8.2 Termination by Us

We reserve the right to suspend or terminate your access immediately, without notice or refund, if:

• You violate these Terms
• You engage in prohibited activities (Section 5.1)
• You share your account
• You attempt to download or redistribute content
• We suspect fraud or illegal activity
• We discontinue the service (with reasonable notice)

8.3 Effect of Termination

Upon termination, your right to access the service immediately ceases, you must stop using all Content, and Sections 2, 6, 9, and 10 will continue to apply.

9. Indemnification

You agree to indemnify, defend, and hold harmless Omnia Bona, LLC, its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: your use of the service; your violation of these Terms; your violation of any rights of another party; or your violation of any law or regulation.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Michigan, United States, without regard to conflict of law principles.

10.2 Jurisdiction

You agree that any legal action or proceeding must be brought in the courts located in Kent County, Michigan, and you consent to the jurisdiction of such courts.

10.3 Informal Resolution

Before filing any legal action, you agree to first contact us at auxilium@omniabona.org to attempt to resolve the dispute informally.

10.4 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes with us on an individual basis and not as part of a class action or consolidated proceeding.

11. General Provisions

11.1 Entire Agreement

These Terms constitute the entire agreement between you and Omnia Bona, LLC regarding the service and supersede all prior agreements.

11.2 Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or notice on the service. Your continued use after changes constitutes acceptance. If you don't agree to changes, you must stop using the service (no refund).

11.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

11.4 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

11.5 Assignment

You may not assign or transfer your rights under these Terms. We may assign these Terms without restriction.

11.6 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, internet outages, etc.).

13. Special Notices for Minors

13.1 Age Requirements

• You must be at least 13 years old to use this service
• If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have parent/guardian permission
• By using this service, you represent that you meet these age requirements

13.2 Parental Consent

If you are a parent or guardian providing consent: you agree to these Terms on behalf of the minor, you are responsible for monitoring their use of the service, and you accept financial responsibility for all charges.

14. Acknowledgment & Consent

By checking the box and/or clicking "I Accept" and/or making a payment, you acknowledge that:

• You have read and understand these Terms in their entirety
• You agree to be bound by these Terms
• You understand that subscriptions are non-refundable
• You understand that you may not download, copy, or redistribute any Content
• You understand that all materials are independently created and not endorsed by the College Board
• You understand that your subscription is for one year only and does not automatically renew
• You understand that sharing your account is prohibited
• You are at least 13 years old (or have parental consent)
